The Himachal Pradesh High Court has granted bail to a man arrested seven months ago on sedition charges stemming from Facebook posts, stating that expressing a desire for peace between India and Pakistan or criticizing the government does not constitute sedition unless there is an intent to incite violence or public disorder. Justice Rakesh Kainthla's single bench emphasized that 'intent' is paramount in such cases. The accused was arrested during 'Operation Sindoor' based on an FIR alleging he uploaded images of banned weapons, a Pakistani flag, and Khalistan-related content to Facebook. However, the court noted that a search of his home yielded no weapons or objectionable materials, only a mobile phone used for uploads and a pen drive with a chat criticizing 'Operation Sindoor'. The court also found no 'Khalistan Zindabad' slogans on his mobile data. Citing Supreme Court precedents like Kedar Nath Singh v. State of Bihar (1962), the High Court reiterated that sedition requires an intention to provoke violence or disturb public peace. The accused was released on a bond of Rs 50,000 with conditions including not tampering with evidence, attending all hearings, and informing police if leaving the city for more than seven days.
