The Himachal Pradesh High Court has granted bail to a youth arrested on sedition charges, stating that expressing a desire for peace between India and Pakistan cannot be considered an act of treason. The court emphasized that intent is crucial in such cases, and merely advocating for the end of hostilities or discussing peace does not fall under sedition. The youth, arrested seven months ago following a Facebook post containing images of banned weapons and a Pakistani flag, was released on a bail bond of ₹50,000. The court noted that no incriminating material, other than a mobile phone and a pen drive with chats criticizing an operation, was found during the search of his residence. Citing Supreme Court precedents, the High Court clarified that sedition requires an intention to incite violence, cause disorder, or disturb public peace, not just criticism of the government or a wish for peace. The court also stated that posting slogans like 'Khalistan Zindabad' without any violent intent does not constitute an offense under Section 153-A.
